The policies on this site are written in Italian, the native language of the store, and provided translated through an automatic translation system for the sole purpose of benefiting the customer's enjoyment of the content. The policy in Italian is the only one that has legal value.

The present conditions are valid between the company Basketball Store srl with registered office in Via Bebio 72 - 76125 Trani (BT), VAT IT09005600722, hereinafter referred to as “Basketball Store” and any person of legal age who makes online purchases on this website hereinafter referred to as “Customer”. These conditions may be subject to change and the date of their publication on the site is equivalent to the effective date. The date of last update is shown at the end of the page.

These conditions govern purchases made on this website, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce. The purchase on this website is reserved for adults.

SUBJECT OF THE CONTRACT

With these general conditions of sale, Basketball Store sells and the Customer purchases at a distance the tangible movable goods indicated and offered for sale on this website. The contract is concluded exclusively through the Internet. The Customer undertakes to read, before proceeding to the confirmation of his order, these general conditions of sale, in particular the pre-contractual information provided by Basketball Store and to accept them by placing a flag in the indicated box. In the order confirmation e-mail, the Customer will also receive a web link (link) to view, download and store a copy of these general terms and conditions of sale (art. 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014).

The Customer, by sending the Order Form, acknowledges and accepts that he/she concludes a contract whose only valid and effective version is the one in the Italian language, while the other versions provided by Basketball Store in any other foreign language are made available to him/her only as a courtesy.

PRECONTRACTUAL INFORMATION

Before the conclusion of the purchase contract, the Customer shall take note of the characteristics of the goods which are illustrated in the individual product sheets at the time of the Customer's choice. Before the validation of the order, the Customer is informed with regard to: total price of the goods including taxes, with details of shipping and any other costs; payment methods; conditions, terms and procedures for exercising the right of withdrawal (art. 6 of these conditions) as well as type of withdrawal form in Annex I, part B of D. lgs 21/2014; information that the Customer will have to bear the cost of returning the goods in case of withdrawal; existence of the legal guarantee of conformity for the purchased goods.

CONCLUSION AND EFFECTIVENESS OF THE CONTRACT

The sales contract is considered concluded upon receipt by the Customer of the order form and by the payment of the consideration made by the available payment methods. To confirm the conclusion of the contract Basketball Store sends the Customer of an e-mail “order confirmation”. The e-mail contains the Customer's data and order number, the price of the purchased goods, shipping costs and the delivery address to which the goods will be sent and the link to be able to print and store the copy of these conditions. The Customer agrees to verify the accuracy of the personal data contained in the above email and to promptly notify Basketball Store of any corrections/changes to be made. Basketball Store undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or minor differences between the product depicted on the site and the actual product may become apparent. Furthermore, photographs of the products presented on this website do not constitute a contractual element, as they are to be considered representative only. Basketball Store agrees to deliver the goods within 14 days commencing from the sending by Basketball Store itself of the order confirmation e-mail to the Customer.

PRODUCT AVAILABILITY

Product availability refers to the actual availability at the time the Customer places the order. However, this availability must be considered purely indicative as the products could be sold to other CUSTOMERS before the confirmation of the order, as a result of the simultaneous presence on the site of several users and that a computer anomaly could occur such as to make available for purchase a product that in reality is not. Even after the order confirmation e-mail sent by Basketball Store, there may be cases of partial or total unavailability of goods. In this eventuality, the order will be rectified automatically with the deletion of the unavailable product or products and the Customer will be immediately informed by e-mail; with this e-mail the Customer will also be informed of the manner and timing of reimbursement of any sums paid.

MODE OF PAYMENT

Any payment by the Customer may be made only by means of the credit cards indicated on this website or by Paypal payment method. Payments are processed by specialized external providers that guarantee high security standards. Credit card details are in no way displayed or stored by Basketball Store.

PRICES

All sales prices of the products shown on this website are in Euros and include VAT. Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before making the payment. The Customer accepts Basketball Store's right to change its prices at any time, however, the goods will be invoiced based on the prices indicated on the site at the time of order creation and indicated in the confirmation e-mail sent by Basketball Store to the Customer. In the event of a computer error, manual, technical, or any other nature that may result in a substantial change, not foreseen by Basketball Store, in the sale price to the public, making it exorbitant or derisory, the purchase order will be considered invalid and canceled and the amount paid by the Customer will be refunded within 14 days. from the day of cancellation.

RIGHT OF WITHDRAWAL

In accordance with current legislation, customers in the European Union have the right to cancel their purchase without penalty and without giving any reason, within 14 days of receiving the products. Customers who wish to exercise their right of withdrawal must notify Basketball Store by submitting an explicit return request, which may be sent via email to info@basketballstore.net or by filling out the “Access and Returns” form located at the bottom of the website. If the right of withdrawal is exercised, the Customer is required to return the goods within 14 days from the day on which they notified Basketball Store of their intention to withdraw from the contract pursuant to Article 57 of Legislative Decree 206/2005. The goods must be returned at the Customer’s expense* to Basketball Store in Italy. The address and delivery instructions will be provided to the Customer upon acceptance of the return request. The goods must be returned intact, unused, in the original packaging (which must also be perfectly intact), complete in all their parts (including packaging and any documentation and accessories), and complete with any labels/tags. Subject to verification of compliance with the above, Basketball Store will refund the amount of the products subject to the return, plus any initial shipping costs, and net of any return shipping costs (€7.90 for customers in Italy) within a maximum of 14 days. Extra shipping costs will not be refunded if a delivery method other than the least expensive option offered was selected. Basketball Store will process the refund using the same payment method chosen by the Customer at the time of purchase. In the case of payment made by bank transfer, and if the Customer intends to exercise their right of withdrawal, they must provide Basketball Store with the bank details: IBAN, SWIFT, and BIC required for Basketball Store to process the refund. For orders shipped outside the European Union, we cannot accept returns or issue refunds.

*It is understood that in the event of a product defect, shipping costs will in any case be borne by Basketball Store.

CHANGE OF GOODS

Without prejudice to the right of withdrawal provided for in Article 7, the Customer may, alternatively, request the replacement of the product due to incorrect size or other reason within 14 days from the date of receipt of the same. The Customer who intends to exercise the merchandise exchange must notify Basketball Store by means of an explicit declaration, which may be transmitted by filling out the “Returns” form for the creation of a computerized practice of Product Change (selectable as “Cause of Return”) or by sending an email to info@basketballstore.net.
In the event of a request for an exchange of goods, the Customer is required to return the good within 14 days from the day he/she notified Basketball Store of his/her desire to make a product exchange. Basketball Store will handle the merchandise exchange with its own courier, arranging both home pickup and delivery of the replacement product at a total cost of €10. The product may be replaced with another item of equal or higher amount (in this case by integration equal to the value of the difference in price). Basketball Store will send the customer guiding communications to simplify the operations of product exchange. For products shipped outside the Italian territory, without prejudice to the right of withdrawal, it will not be possible to request an exchange of goods.
The goods must be returned undamaged, unused, in the original packaging (also perfectly intact), complete in all its parts (including packaging and any documentation and accessory equipment), complete with any labels/tags. Without prejudice to the right to verify compliance with the above, Basketball Store will send the Customer the replacement product requested within a maximum period of 14 days, charging the same the replacement cost of €10 in addition to any price differences between the products subject to replacement.

LEGAL GUARANTEE OF CONFORMITY

The purchase of the product is subject to the rules set forth in Legislative Decree no. 206/2005 (Consumer Code) on sales contracts and warranties concerning consumer goods and/or by the specific provisions set forth in this regard by the Civil Code. In case of receipt of defective products or otherwise not in accordance with the orders placed, the Customer has the right to restore the conformity of the product without charge by repair or replacement of the product. The Customer may exercise this right if the defect becomes apparent within two years of delivery of the goods and reports the defect to Basketball Store within two months of discovery. In order to exercise the above right, the Customer must proceed to create a computer file of Return by filling the “Returns” form. Basketball Store, in case of defective or non-conforming product, will, at its own expense, arrange for the withdrawal of the product, consistent with the availability of the Customer. The legal warranty concerns the product that has conformity defects and cannot be invoked in case of negligence and/or carelessness in the use and/or maintenance of the product. The returned product will be evaluated by Basketball Store technicians and/or the manufacturing company. In case of confirmation of the defect (thus excluding breakage due to normal wear and tear or incorrect use of the product), the product will be replaced with the same model or a voucher will be issued equal to the current value of the item in question (if the same is no longer available for replacement).

COUPON CODES

Basketball Store reserves the right to create promotional coupon codes that can only be used for orders of €49 or more.

DELIVERY METHODS

Basketball Store ships to Italy and European Union countries. Orders can also be placed from non-EU countries, provided that they are eligible for checkout and the shipping option is available on the order form, depending on the courier's availability. For shipments to countries outside the European Union, any customs duties, taxes, import taxes, or other charges required by local authorities are entirely the responsibility of the Customer, who is solely liable for them. The Customer is also required to verify that it is legal to purchase, import, possess, and use the products ordered in the country of destination. Basketball Store cannot be held responsible for any blocks, seizures, or delays due to local regulations or customs procedures. Products are normally delivered within a few business days of order confirmation; in any case, products will be delivered by express courier to the address indicated by the Customer no later than 30 (thirty) days from the date of receipt of the order confirmation email.

INVOICING

For each order placed on this website, Basketball Store will issue a receipt for the purchased goods. Should the Customer require a commercial invoice, this must be requested by sending an email to the email address info@basketballstore.net or through the online contact form, enclosing all billing data including VAT number and - alternatively - the SDI code or certified email address PEC for the issuance of the electronic invoice.

RESPONSIBILITY

Basketball Store assumes no liability for inefficiencies attributable to force majeure or unforeseeable circumstances, even where dependent on malfunctions and inefficiencies of the Internet, in the event that it fails to execute the order within the time stipulated in the contract.

ACCESS TO THE SITE

Customer has the right to access the site for consultation and making purchases. No other use, particularly commercial, of the site or its content is permitted. The integrity of the elements of this site, whether aural or visual, and the related technology used remain the property of Basketball Store and are protected by intellectual property law. It is strictly prohibited to use on the site: automated bots, scripts, crawlers and other automatic systems to read the content.

COOKIES
This website uses ''cookies''. Cookies are electronic files that record information related to the Customer's navigation on the site (pages consulted, date and time of consultation, etc..) and allow Basketball Store to offer a personalized service to its customers. Basketball Store informs the Customer of the possibility to disable the creation of such files by accessing its Internet configuration menu. INTEGRALITY

The present General Terms and Conditions of Sale consist of the entirety of the clauses that comprise them. If one or more of the provisions of these General Terms and Conditions of Sale is deemed invalid or declared invalid pursuant to law, regulation, or following a decision by a court having jurisdiction, the other provisions shall continue to be in full force and effect.

APPLICABLE LAW AND COMPETENT COURT

The present General Terms and Conditions of Sale are subject to Italian law. Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of Trani.
